On August 23, 2012 Gilberto was in the area of 19th and Y Street selling ice cream from his ice cream stand when he was shot. Omaha Police were dispatched to the area at 8:22 p.m in reference to a shooting. Officers located Gilberto down in the middle of the street. Gilberto was transported to a local hospital where he was pronounced deceased.
